GENERAL TERMS AND CONDITIONS OF SALE AND USE OF THE WEBSITE SWIMLDC.COM

1. Introduction and definitions

These General Terms and Conditions of Sale and use of the website (the “Terms”) govern the online purchase of L.D.C. LAGO DI COMO branded products (the “Products”) through the website www.swimldc.com (the “Website”) by L.D.C. LAGO DI COMO S.r.l. (the “Seller”), with registered office at Via Parini 10, 22100 Como (CO), Italy, Tax Code/VAT No. 04225930132, REA Como No. 429181.

Sales through the Website are reserved exclusively for consumers pursuant to Article 3 of Legislative Decree No. 206/2005 (the “Consumer Code”), i.e. natural persons acting for purposes unrelated to their business or professional activity.

2. Scope and acceptance

These Terms apply to all orders placed on the Website. Before placing an order, the Customer is invited to read them carefully and retain a copy.

Submitting an order implies full acceptance of these Terms.

3. Access to the Website and account

The Customer may purchase with or without registering on the Website. If an account is created, the Customer is responsible for the accuracy of the information provided and for maintaining the confidentiality of login credentials.

4. Intellectual property

All content on the Website (trademarks, images, texts, design, layout, videos, etc.) is protected by intellectual and industrial property laws. Any unauthorized reproduction or use is prohibited.

Some images on the Website may be generated or modified using artificial intelligence (AI) tools for illustrative purposes.

5. Product information

The essential characteristics of the Products are described in the relevant product pages. Images may not perfectly reflect colors and details for technical reasons (screens, browsers, etc.).

Products are new and equipped with labels/tags. In the event of a return, they must be returned intact and without signs of use.

6. Purchase procedure and conclusion of the contract

To make a purchase, the Customer selects the Products, adds them to the cart, and completes checkout by entering the required information.

The Seller will send an order receipt email. The contract is considered concluded upon sending the order confirmation.

The Seller reserves the right to cancel the order in case of product unavailability, anomalies, or force majeure events.

7. Payments

The payment methods indicated on the Website are accepted (e.g. cards, PayPal, Scalapay). For installment payments, the provider’s terms also apply.

8. Prices, currency, taxes and duties

For shipments within the European Union, prices are expressed in Euro and include VAT where applicable. Shipping costs are indicated separately before order confirmation.

For shipments outside the European Union, any customs duties, taxes, and import charges are not included in the price and are borne by the Customer. These charges will be requested from the Customer and collected by the carrier prior to delivery.

9. Shipping and delivery

Deliveries are handled by the couriers indicated in the relevant section.

Estimated delivery times:

  • Italy: within 5 working days
  • International: within 10 working days

In any case, delivery shall take place within 30 days from the conclusion of the contract.

Risk transfers to the Customer upon delivery.

The Customer is required to check the integrity of the package and report any anomalies.

10. Right of withdrawal (14 days)

The Customer has the right to withdraw within 14 days from receipt of the Products without providing any reason.

To exercise the right of withdrawal, the Customer must complete the RETURN FORM available in the Refund Policy section. For assistance, customers may also contact customercare@swimldc.com.

11. Conditions for return acceptance

Returns are accepted only if:

  • the Product has not been used
  • it has not been washed or damaged
  • it is returned with its original packaging
  • all tags are intact
  • for swimwear: tried on over underwear

Otherwise, the Seller may refuse the return or reduce the refund.

12. Return procedure

The Customer must complete the RETURN FORM in the Refund Policy section.

After approval, the Customer will receive shipping instructions.

Returns from different orders cannot be combined.

The deadline to request a return is 14 days from receipt of the Products.

13. Refunds

The refund concerns the Product price, net of return costs where applicable.

It will be issued within 14 days from receipt of the returned goods or proof of shipment.

14. Incorrect or damaged products

The Customer must report any issues within 48 hours of delivery, attaching photos.

In such cases, costs are borne by the Seller.

15. Legal guarantee of conformity

The legal guarantee provided by the Consumer Code applies.

17. Force majeure

The Seller shall not be liable for delays due to force majeure events.

18. Applicable law and jurisdiction

Italian law applies.
For EU customers: jurisdiction of the consumer’s place of residence.
For non-EU customers: Court of Como.

19. Privacy

The processing of personal data is governed by the Website’s Privacy Policy.

20. Limitation of liability

The Website is provided “as is”. The Seller shall not be liable for malfunctions or improper use.

21. Dispute resolution (ODR)

The Customer may access the European ODR platform.

22. Final provisions

The invalidity of any clause shall not affect the validity of the remaining provisions.
